Medical Support

In compliance with the new federal regulations,  Ohio laws regarding medical support (ORC 3119.29 & following)  have changed. The Ohio Revised Code continues to require that all child support orders require the obligor  and/or obligee to purchase  private health insurance coverage if it  is reasonable in cost, and adds the requirement that the  non-custodial parent pay a cash medical support payment during any period when the child is not covered by private health insurance.  

If the child or children are not currently enrolled in health insurance coverage,  there will be a cash medical support payment in addition to the child support payment. In other words,  the child support payment  will be either:

  1. A child support payment amount when health insurance is provided  OR 
  2. A child support payment amount when health insurance is not  provided and a cash medical support payment.

This does not apply to existing cases; only new orders or orders that are modified.
